Terms of Service

1. Acceptance of terms
By accessing opsiq.co.za or using the OpsIQ platform, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These terms apply to all users, including website visitors, registered platform users, and client organisations.
2. Description of service
OpsIQ provides a workforce capability intelligence platform including digital SOP management, competency verification, skills mapping, analytics, and related professional services.
The platform is provided as a Software as a Service (SaaS) product under a separate commercial agreement. These Terms govern general use of the website and platform.
3. Acceptable use
You agree not to:
- Use the platform for any unlawful purpose
- Upload content that is false, misleading, or violates any third-party rights
- Attempt to gain unauthorised access to any part of the platform or its infrastructure
- Reverse engineer, decompile, or copy any part of the platform
- Use automated tools to scrape or extract data from the platform
- Interfere with the security or integrity of the service
4. Accounts and access
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at info@opsiq.co.za if you suspect unauthorised use of your account.
Each user account is for a single individual. Sharing accounts is not permitted unless expressly authorised in your service agreement.
5. Intellectual property
All content, software, designs, trademarks, and data on the OpsIQ platform and website are the intellectual property of OpsIQ (Pty) Ltd or its licensors. No licence to copy, reproduce, or distribute any content is granted unless expressly stated.
Client-uploaded content (SOPs, evidence, job cards) remains the property of the client. By uploading content, you grant OpsIQ a limited licence to store and process it for the purpose of providing the service.
6. Data and privacy
OpsIQ processes personal information in accordance with our Privacy Policy (opsiq.co.za/privacy) and the Protection of Personal Information Act 4 of 2013 (POPIA).
Clients are responsible for ensuring they have the necessary authority to upload and process personal information of their employees and learners on the platform.
7. Service availability
OpsIQ aims to maintain a 99.5% monthly uptime for the platform. Scheduled maintenance windows will be communicated in advance where possible.
We do not guarantee uninterrupted access and are not liable for temporary outages caused by factors outside our control, including third-party infrastructure failures.
8. Limitation of liability
To the maximum extent permitted by law, OpsIQ is not liable for indirect, incidental, or consequential damages arising from use of the platform or website.
Our total liability to any client for any claim shall not exceed the fees paid by that client in the three months preceding the claim.
9. Termination
We reserve the right to suspend or terminate access to the platform for breach of these terms, non-payment, or any conduct that harms OpsIQ or its users.
On termination, client data will be retained for 30 days during which the client may request an export, after which it will be deleted.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa, or through mediation and arbitration as agreed between the parties.
11. Changes to these terms
We may update these Terms from time to time. Continued use of the platform after changes are published constitutes acceptance. We will notify registered users of material changes by email.
